  • ​Trademark (for goods) - any word, name, design or symbol that is used in commerce to identify & distinguish the goods of one manufacturer or seller from that of another, and to indicate the source of those goods.  

  • Service mark (for services) - any word, name, design or symbol that is used in commerce to identify & distinguish the services of a manufacturer or seller from that of another, and to indicate the source of those services.  

Types of Trademark Applications

  • Intent to Use - for marks that are not currently being used in connection with the intended goods/services, but are planned to be used in the future.

  • Actual Use - for marks that are currently being used in connection with the intended goods/services.

Benefits of Federal Trademark Registration

  • Constructive notice nationwide of the trademark owner's claim.

  • Evidence of ownership of the trademark.

  • Jurisdiction of federal courts may be invoked for enforcement actions against infringers.

  • Serves as basis for obtaining registration in foreign countries.

  • May be filed with U.S. Customs Service to prevent importation of infringing foreign goods.
